This End-User Licence Agreement ("EULA")
is a legal agreement between you (either an individual or a single
entity) and SurfaceSpectra Limited ("SurfaceSpectra")
covering the use of the Isotope Pattern Viewer software ("SOFTWARE").
The SOFTWARE includes computer software, any associated media,
any printed materials and any "on-line" or electronic
documentation. By installing, copying or otherwise using the SOFTWARE,
you agree to be bound by the terms of this EULA. If you do not
agree to the terms of this EULA, SurfaceSpectra are unwilling
to license the SOFTWARE to you. In such event, you should promptly
delete all copies of the software from your computer.
SOFTWARE PRODUCT LICENCE
The SOFTWARE is protected by copyright laws and
international copyright treaties, as well as other intellectual
property laws and treaties. The SOFTWARE is licensed, not sold.
1. Grant of licence
This EULA grants you the following rights:
* You may install and use any number of copies of the SOFTWARE
on any number of computers.
* You may also store or install a copy of the SOFTWARE on a computer
to allow your other computers to use the SOFTWARE over an internal
network.
* You may make a back-up copy of the SOFTWARE for archival purposes.
2. Description of other rights and limitations.
* You may not reverse engineer, decompile or disassemble the SOFTWARE.
* You may not rent or lease the SOFTWARE.
* You may permanently transfer all your rights under this EULA
to another person or single entity provided the recipient agrees
to the terms of this EULA.
* Without prejudice to any other rights, SurfaceSpectra may terminate
this EULA if you fail to comply with the terms and conditions
of this EULA. In such event, you must delete any copies of the
SOFTWARE from your computer.
3. Copyright
All title and copyrights in and to the SOFTWARE, and any accompanying
printed materials, are owned by SurfaceSpectra.
Requests for permission for copying for general distribution,
for advertising or promotional purposes, for creating new collective
works for resale, and other enquiries should be addressed to SurfaceSpectra.
4. Warranty
SurfaceSpectra assumes no responsibility or liability for any
damage or injury to persons or property arising out of the use
of any materials, instructions, methods or ideas contained in
the SOFTWARE. SurfaceSpectra expressly disclaims any implied warranties
of merchantability or fitness for a particular purpose. Further,
SurfaceSpectra does not warrant, guarantee, or make any representations
regarding the use, or the results of use, of the software or written
materials in terms of correctness, accuracy, reliability, currentness,
or otherwise. The entire risk as to the results and performance
of the SOFTWARE is assumed by the user.
Neither SurfaceSpectra nor anyone else who has been involved in
the creation, production or delivery of the SOFTWARE shall be
liable for any direct, indirect, consequential or incidental damages
(including damages for loss of business profits, business interruption,
loss of business information, and the like) arising out of the
use or inability to use such product even if SurfaceSpectra has
been advised of the possibility of such damages.
If expert assistance is required, the services of a competent
professional person should be sought.
This limited warranty shall be governed and construed in accordance
with the laws of England.
ACKNOWLEDGEMENT
By using the SOFTWARE you acknowledge that you
have read this limited warranty, understand it, and agree to be
bound by its terms and conditions. You also agree that the limited
warranty is the complete and exclusive statement of agreement
between the parties and supersedes all proposals or prior agreements,
oral or written, and any other communications between the parties
relating to the subject matter of the limited warranty.
